Delhi Gymkhana Club plea: High Court adjourns hearing for September 3

The Delhi High Court deferred the hearing in the Delhi Gymkhana Club eviction case after Senior Advocate Abhishek Manu Singhvi informed the court that the Centre had filed its counter affidavit late on Monday night.

Justice Avneesh Jhingan directed all parties to complete their pleadings without delay and posted the matter for further hearing on September 3.

The court also ordered that the interim protection and assurances granted in the connected proceedings would continue until the next date of hearing.

Delhi Gymkhana Club row: Government's latest eviction bid

The land and development office of the housing and urban affairs ministry had in May asked the Delhi Gymkhana Club to vacate its premises on Safdarjung Road by June 5, citing the need to strengthen and secure defence infrastructure and other public-interest projects. A few days later, after members objected to the takeover move, the Centre assured the Delhi High Court that there would be no forcible possession of the property and that it would follow the due process of law.

In its June 29 notice, the land and development office iterated its right to re-enter the premises following the termination of the lease between the government and the club on May 22. It directed the club and all persons concerned to file their response and appear before it on July 7.

Delhi Gymkhana Club eviction pleas Live: Brief recap of last hearing

On July 6, the Delhi High Court asked the Centre to respond to petitions filed by members and staff of the Delhi Gymkhana Club challenging a show cause notice seeking their eviction from the club's 27.3-acre premises.

Justice Avneesh Jhingan issued notice to the Centre on applications seeking a stay on the eviction proceedings and posted the matter for July 28. The court also directed the government to defer the July 7 hearing before the estate officer until after the next court hearing.

The petitions challenge the June 29 showcause notice, which requires the club to explain why it should not be evicted under the Public Premises (Eviction of Unauthorised Occupants) Act, 1971.
