Delhi court sentences three to 6-year imprisonment in 2019 Badarpur stabbing case

A Delhi court has sentenced three men to six years' rigorous imprisonment in a 2019 stabbing case in the Badarpur area, holding that they acted with a common intention while attacking a youth. The three convicts are Sahil alias Ishmile, Mohit, and Vishal alias Vicky.

Principal District and Sessions Judge Umed Singh also imposed a fine of Rs 10,000 on each of them after convicting them under Sections 307 and 34 of the Indian Penal Code.

In an order dated September 22, the court said, "Taking into account all these mitigating and militating facts, all the convicts namely Sahil alias Ishmile, Mohit and Vishal alias Vicky, are sentenced to rigorous imprisonment for a period of 06 years and a fine of Rs.10,000/- each".

The court directed that all the sentences would run concurrently and gave the convicts the benefit of the period already spent in custody. It had convicted the three men under Section 307/34 of the IPC in its September 19 judgment, saying the accused had acted with a common intention.

According to the prosecution, the three men assaulted brothers Mukul and Manish on November 15 in Molarband Extension in Badarpur. During the attack, two of the accused allegedly caught hold of Mukul while Sahil struck him with a poker. The weapon pierced his back and remained lodged in his body.

Mukul later underwent surgery at Apollo Hospital, where doctors found that the poker had pierced his lung and that its tip was less than half a centimetre from the aorta, the main blood vessel that carries oxygen and nutrients from the heart to the organs.

The prosecution had sought the maximum punishment, arguing that the seriousness and gravity of the offence did not justify leniency.

The defence, however, sought leniency on the ground of the convicts' family responsibilities, their ages, and the fact that they had been facing trial since 2019.

The court noted that none of the three had any other pending case and that they had already spent varying periods in jail in the matter.

The court said Sahil had already spent eight months and seven days in custody, Vishal one year and nine months, and Mohit 10 months and 15 days.

With the latest order, the three men have been sentenced to six years' rigorous imprisonment and fined Rs 10,000 each in the Badarpur stabbing case.
